What this service may not be used for

What you may not send through this service, and what happens if you do.

Do not send unsolicited advertising

Sending unsolicited advertisements by fax is prohibited here and is unlawful in the United States under the Telephone Consumer Protection Act and the Junk Fax Prevention Act. Liability for a junk fax falls on the sender, and using this service to send one does not move it to us.

Also prohibited

  • Bulk or repeated sending to recipients who have not asked to hear from you
  • Sending content that is unlawful, fraudulent, or intended to harass or threaten the recipient
  • Impersonating another person or organization as the sender
  • Sending material you have no right to send
  • Sending to a number you know is wrong, or to one you have no good reason to believe is a fax line
  • Automating the service, reselling transmissions, or sending faxes for other people as a business of your own

Our payment processor and our fax network forbid some things outright, so we do too: sexually explicit material, material that sexually exploits a child — which we report to the National Center for Missing and Exploited Children where we learn of it, as federal law requires — and use in connection with a business on Stripe’s restricted list.

What we do about it

We keep enough non-content metadata — destinations, timing, volume — to investigate a complaint, and we will provide it where the law requires. We do not read your documents to do this, and once the schedule in the retention policy has run there is nothing left to read.

When someone tells us a fax sent through this service broke this policy, we look at the metadata for that transmission and answer them with what it shows. A fax is dialed within seconds of being submitted, so by the time a complaint reaches us the transmission has already happened. What we can act on afterwards is the charge. A test page has no charge, so what we can act on there is the small daily allowance of test pages for that number and that address, which the test page itself describes. Breaching this policy also ends your permission to use the service, but there is no account here, so that is a term of the contract rather than a lock we can turn.

If you send something you had no right to send, or send to a number you knew was wrong, and someone else brings a claim against us over it, the cost of dealing with that claim is yours rather than ours, to a limit of $10,000. We will tell you promptly, will not settle without asking you, and you may take over the defense. This does not cover a claim that arises from something we did wrong.

Sender identification

US rules require a fax sent from a computer to carry, on the first page, the date and time it was sent, who sent it, and the telephone number of the sending machine. Where you add a cover sheet and give us a sender name, that name is printed on it, and giving a false one breaches this policy.

Reporting misuse

If you received a fax you believe was sent through this service in breach of this policy, write to support@faxmydoc.com with the date, time and receiving number. Include the transmission header if your machine printed one.
