Terms of service
These terms cover your use of FaxMyDoc, operated by Goforth Digital Ventures LLC. Using the service means you accept them.
What the service does
You upload a document, we convert it into fax-compatible pages, transmit it to the US fax number you give us, and send you a record of what happened. One transmission, one destination, up to 30 pages, $4.99 charged once. No account, no subscription. We do not receive faxes, rent you a number, or send outside the United States.
You choose the destination
The fax number is yours to supply and yours to verify. We do not look numbers up and we do not check that a number belongs to the organization you named, so a transmission to a wrong number may still be confirmed and is not a failure of the service. Where we publish a number for an agency or a form, it was read off that organization’s own page on the date shown beside it and can change without notice. The number on your own paperwork wins.
What a confirmation means
“Transmission confirmed” means the receiving fax system answered and acknowledged the pages shown on your record. It does not confirm that a person reviewed the document, that the recipient organization routed or accepted it, or that any filing requirement or deadline was legally satisfied.
Payment
Your card is authorized when you press send and charged only once a transmission is confirmed by the receiving fax system. If it does not complete after our automatic retries, the authorization is released and you are not charged. There are no recurring charges or stored cards, and each transmission is a separate charge. The charge appears on your statement as FAXMYDOC* FAX SEND, we email you a record showing the number dialed, the page count and the time, and Stripe emails the receipt.
Once a fax is confirmed we do not refund it; the work is done. If an operational problem on our side caused a charge for one that did not complete, write to us with your record ID and we will return it. If anything about a charge looks wrong, write to us before you contact your bank; we hold the record and can usually answer in a day.
Your document
You keep ownership of everything you upload, and you give us permission to process and transmit it only to send your fax. It is destroyed 24 hours after transmission under the retention policy, so keep your own copy.
You confirm you have the right to send what you upload, that sending it does not break the law, that the recipient asked for this document or has a relationship with you that makes sending it appropriate, and that you are not sending an advertisement to someone who did not agree to receive one. Prohibited uses are in acceptable use, and breaching that policy ends your permission to use the service.
We do not market this service as HIPAA compliant and will not sign a business associate agreement, so covered entities and business associates must not send protected health information through it. Everyone else may send their own medical records freely.
If a fax is late, or never arrives
Transmissions fail for reasons outside anyone’s control — busy lines, machines out of paper, numbers that have been reassigned. We retry automatically and email you the moment one fails, so you still have time to send another way. Nothing on this site promises a fax will reach a machine by a particular time, so send early enough that a failure leaves you room. Time is not of the essence in this agreement.
This is the part that limits what you can recover, including when the loss is our fault. To the extent the law allows, our total liability for any claim relating to the service, or to anything we publish on this site — including a claim that we were negligent, or that a fax failed, was late, went to the wrong machine, or was never sent — is limited to the amount you paid for that transmission, or $4.99 if you were not charged. We are not liable for indirect or consequential losses, a missed deadline and a rejected filing included.
We make no promise about the service beyond what this page says, and to the extent the law allows we disclaim the warranties it would otherwise imply. What we stand behind is every fact we state on this site. Your rights under the Texas Deceptive Trade Practices Act survive this agreement.
The rest of it
You need to be 18 and able to enter a contract. Texas law governs, and a dispute is heard in the courts sitting in Dallas County, Texas — except small claims, which you may bring wherever you live. Any claim about a transmission must be brought within two years of the day it arises.
If any part of these terms is held unenforceable, the rest still applies. We may transfer this agreement if the business is sold; you may not. These terms, the acceptable use policy, the retention policy and the privacy policy are the agreement between us. If they change we will update the review date below, and the terms in force when you send a fax govern that transmission.
